Terms of Service

These terms govern your use of web design and hosting services provided by Bild Agency ("we", "us", "our"). By subscribing to our services, you agree to these terms.

1. Services

We provide website design, hosting, and maintenance services on a monthly subscription basis. Your subscription includes:

  • Basic Plan ($499 setup + $49/month): 5-page website, hosting, SSL, maintenance, and edit requests via email. One-time setup fee covers design and build; monthly fee covers hosting and support.
  • Advanced Plan ($799 setup + $79/month): 8-10 page website, hosting, SSL, maintenance, priority edit requests via email, and expanded content. One-time setup fee covers design and build; monthly fee covers hosting and support.

We will design and deploy your website based on the information you provide through our questionnaire. You will have the opportunity to review preview designs before payment.

2. Payment and Billing

  • A one-time setup fee is charged at the time of purchase. Your monthly hosting and support subscription is billed on the anniversary of your first payment.
  • All prices are in US Dollars (USD). Payments are processed by Stripe. We do not store your card details.
  • If a payment fails, we will retry up to 3 times over 9 days.
  • If all retries fail, your website may be suspended until payment is resolved.

3. Cancellation

  • You may cancel your subscription at any time by emailing josh@bildagency.com.
  • Cancellations require 30 days written notice.
  • Your website will remain live for 30 days following your cancellation notice.
  • No refunds are provided for partial months.

4. Domain Names

  • If you provide your own domain, you retain full ownership and DNS control at all times.
  • If we register or manage a domain on your behalf, we will transfer full ownership and DNS control to you within 7 days of a written request, at no charge.
  • We will never hold a domain hostage or charge a transfer fee.

5. Intellectual Property

  • Your content: You retain ownership of all text, images, logos, and other materials you provide to us.
  • Our work: The website design, code, and structure we create for you are licensed to you for use on your website for the duration of your subscription.
  • After cancellation: You may request a copy of your website files at any time. We will provide them within 7 days of request.
  • We reserve the right to showcase your website in our portfolio unless you request otherwise in writing.

6. Edit Requests

  • Edit requests are submitted via email to josh@bildagency.com.
  • We aim to complete edits within 24-48 hours on business days.
  • Edits include changes to text, images, layout adjustments, and minor feature additions.
  • Major redesigns or significant scope changes may require a plan upgrade or separate agreement.

7. Liability

  • Our total liability for any claim arising from our services is limited to the amount you have paid us in the 3 months preceding the claim.
  • We are not liable for any indirect, incidental, or consequential damages, including lost profits or business interruption.
  • We do not guarantee specific search engine rankings, traffic levels, or business outcomes from your website.
  • We will make reasonable efforts to maintain uptime but do not guarantee uninterrupted service. Cloudflare Pages provides the underlying hosting infrastructure.

8. Acceptable Use

Your use of our services is subject to our Acceptable Use Policy. We reserve the right to suspend or terminate service for violations.

9. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email at least 14 days before they take effect. Continued use of our services after changes take effect constitutes acceptance.

10. Governing Law

These terms are governed by the laws of South Africa. Any disputes will be resolved in the courts of Johannesburg, Gauteng.
